Information on data processing pursuant to EU Regulation 679/2016

informs you pursuant to art. 13 Legislative Decree no. 196 of 30.6.2003 (hereinafter, "Privacy Code") and art. 13 EU Regulation no. 2016/679 (hereinafter, "GDPR") that your data will be processed in the following ways and for the following purposes:

  1. Object of the Processing
    The Data Controller shall process the personal, identifying data (e.g. first name, last name, company name, address, telephone number, e-mail, bank and payment references - hereinafter, "data") communicated by you when signing the contract and for any other services you request from the Data Controller. No data of a medical or criminal nature will be processed.

 

  1. Purpose of processing

Your personal data are processed:
A) without your express consent (art. 24 lett. a), b), c) Privacy Code and art. 6 lett. b), e) GDPR), for the following Service Purposes
- to carry out the services you have requested from the Data Controller for the provision of services such as: digital commerce, integrated marketing, world wide operations, omni-channell customer experience;
- to comply with the obligations provided for by law (administrative, accounting, tax and fiscal), by a regulation, by EU legislation or by an order from the Authority
- to exercise the Controller's rights, such as the right of defence in court;
B) Only with your specific and distinct consent (Articles 23 and 130 Privacy Code and Article 7 GDPR), for the following Marketing Purposes
- to send you by e-mail, post and/or sms and/or telephone contact, newsletters, commercial communications and/or advertising material services and special offers.

 

  1. Processing methods
    The processing of your personal data is carried out by means of the operations indicated in art. 4 Privacy Code and art. 4 n. 2) GDPR and precisely: collection, recording, organisation, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction of data. Your personal data will be processed both on paper and electronically. The data will be processed, processed and stored within our computer systems. The Data Controller will process your personal data for the time necessary to fulfil the above-mentioned purposes and in any case for no longer than 10 years from the termination of the relationship for administrative service purposes and for no longer than 1 year from the collection of the data for Marketing Purposes.

  1. Data Communication
    Without the need for your express consent (ex art. 24 lett. a), b), d) Privacy Code and art. 6 lett. b) and c) GDPR), the Data Controller may communicate your data for the purposes of art. 2.A) Judicial Authorities in the event that they explicitly request it, as well as to those subjects to whom communication is obligatory by law for the fulfilment of the aforementioned purposes. These subjects will process the data in their capacity as autonomous data controllers. Your data will not be disseminated.

  2. Data transfer
    Personal data are stored in our computer system and servers will be used for data storage both in Italy and in other European countries. It is in any case understood that the Data Controller, should it become necessary, will have the right to move the servers to server farms residing outside the EU. In this case, the Data Controller assures as of now that the data transfer will take place in compliance with the applicable legal provisions, subject to the stipulation of the standard contractual clauses provided for by the European Commission.

  3. Nature of data provision and consequences of refusal to answer
    The provision of data for the purposes set out in Article 2.A) is mandatory. In their absence, we will not be able to guarantee you the Services of art. 2.A).

 

  1. Rights of the interested party

In your capacity as an interested party, you have the rights referred to in the art. 7 Privacy Code and art. 15 GDPR and precisely the rights of:

i.the obtain confirmation of the existence or otherwise of personal data concerning you, even if not yet registered, and their communication in an intelligible form; ii.obtain indication of: a) the origin of the personal data; b) the purposes and methods of processing; c) of the logic applied in case of processing carried out with the aid of electronic instruments; d) the identification details of the owner, managers and representative designated pursuant to art. 5, paragraph 2 Privacy Code and art. 3, paragraph 1, GDPR; e) of the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them in their capacity as designated representatives in the territory of the State, managers or agents; iii. obtain: a) updating, rectification or, when interested, integration of data; b) the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including those whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed; c) certification that the operations referred to in letters a) and b) have been brought to the attention, also with regard to their content, of those to whom the data have been communicated, except in the case in which such fulfillment proves impossible or involves the use of means that are manifestly disproportionate to the protected right; iv. object, in whole or in part: a) for legitimate reasons to the processing of personal data concerning you, even if pertinent to the purpose of the collection; b) to the processing of personal data concerning you for the purpose of sending advertising material. Please note that the interested party's right of opposition, set out in the previous point b), for direct marketing purposes using automated methods, extends to traditional ones and that in any case the possibility for the interested party to exercise the right of opposition also remains only partially. Therefore, the interested party can decide to receive only communications via traditional methods or only automated communications or neither of the two types of communication.Where applicable, you also have the rights referred to in the articles. 16-21 GDPR (Right of rectification, right to be forgotten, right to limit processing, right to data portability, right to object), as well as the right to complain to the Guarantor Authority. Please also note that it will be your duty to promptly communicate the update of your data by email and/or registered letter.
